{"id":66098,"date":"2025-07-16T01:00:59","date_gmt":"2025-07-16T08:00:59","guid":{"rendered":"https:\/\/civileats.com\/?p=66098"},"modified":"2025-07-16T08:03:29","modified_gmt":"2025-07-16T15:03:29","slug":"immigrant-farmworkers-win-housing-rights-in-vermont","status":"publish","type":"post","link":"https:\/\/civileats.com\/2025\/07\/16\/immigrant-farmworkers-win-housing-rights-in-vermont\/","title":{"rendered":"Immigrant Farmworkers Win Housing Rights in&nbsp;Vermont"},"content":{"rendered":"<\/div><div class=\"post-simple post-capital-letter\"><p>Under a freshly enacted <a href=\"https:\/\/legislature.vermont.gov\/Documents\/2026\/Docs\/ACTS\/ACT069\/ACT069%2520As%2520Enacted.pdf\">Vermont bill<\/a> on housing that bars discrimination on the basis of citizenship or immigration status, immigrant farmworkers no longer need to submit a social security number on rental applications.<\/p><\/div><div class=\"post-simple\">\n<p>Moreover, landlords cannot refuse an application if that number is not provided; they must accept any form of unexpired government-issued identification. They also cannot charge application fees for a residential dwelling.<\/p>\n<p>Republican Governor Phil Scott signed Senate Bill 127, the Vermont Rental Housing Improvement Program, on June 12, and the next day, <a href=\"https:\/\/civileats.com\/2025\/04\/24\/federal-agents-detain-workers-at-a-vermont-dairy-farm\/\">Migrant Justice<\/a>\u2014the Vermont-based organization that conceived the measure\u2014took to the State House steps to celebrate.<\/p>\n<p>\u201cThis is a really big deal for us, and maybe it wouldn\u2019t seem like such a big deal for everybody if they haven\u2019t been in that situation,\u201d said a member of Migrant Justice who requested anonymity to protect her from reprisals.<\/p>\n<p>The member said that in Vermont, opportunities for undocumented immigrant families to find housing are slim. While individuals who have been naturalized or received green cards are eligible for federally subsidized housing, undocumented individuals are not, which reduces housing opportunities for them. H-2A guest workers, typically single men employed under seasonal contracts, aren&#8217;t generally seeking housing, as their lodging is provided by their employers\u2014often on the farm itself.<\/p>\n<p>As a result, the member continued, many immigrants in Vermont struggle to find secure, safe living situations.<\/p>\n<\/div><div class=\"post-image-caption align-center\"><a href=\"https:\/\/civileats.com\/wp-content\/uploads\/2025\/07\/250716-vermont-enshrines-housing-protections-for-immigrants-in-new-bill-inline-celebration.jpg\" rel=\"lightbox\"><img decoding=\"async\" src=\"https:\/\/civileats.com\/wp-content\/uploads\/2025\/07\/250716-vermont-enshrines-housing-protections-for-immigrants-in-new-bill-inline-celebration.jpg\" alt=\"Scenes from an immigrant housing law celebration at the Vermont State House in Montpelier. (Photo credit: Terry Allen)<\/p>\n<\/div><\/div><div class=\"post-simple\">\n<p>\u201cWe\u2019ve been seeing a lot of abuses,\u201d Representative Leonora Dodge (D-Essex), who sponsored the bill, said. \u201cA lot of young families are experiencing very dangerous situations, overcrowding, and instability. It\u2019s a very tough housing market in Vermont, and people who were able and willing to pay rent, and could give good references, just weren\u2019t even getting a foot in the door and were being rejected.\u201d<\/p>\n<p>A <a href=\"https:\/\/vhcb.org\/wp-content\/uploads\/2025\/07\/Vermont-Farmworker-Housing-Needs-Assessment.pdf\">2021 report<\/a> published by the Vermont Housing Conservation Board found that 85 percent of farmworker housing in the state needed improvement, and that a lack of additional dwellings on farms had led to overcrowding.<\/p>\n<p>Year-round migrant dairy workers make up the largest group of immigrant farmworkers in Vermont, and the majority\u2014whether single workers or families\u2014live on the farms where they work. Having an employer who doubles as a landlord puts immigrant workers \u201cin a particularly precarious and vulnerable position, as they may be less likely to report discrimination, poor working, or poor housing conditions to government officials due to fear of deportation and are unable to access federal funds to support their housing needs,\u201d according to the state\u2019s <a href=\"https:\/\/outside.vermont.gov\/agency\/ACCD\/ACCD_Web_Docs\/Housing\/Fair-Housing\/Analysis-of-Impediments\/2024_FHA.pdf?_gl=1*12y0lou*_ga*OTYyNjM0MjQwLjE3NTA5NzIyMjE.*_ga_V9WQH77KLW*czE3NTEzMTEyOTEkbzIkZzAkdDE3NTEzMTEyOTgkajUzJGwwJGgw\">2024 Fair Housing Analysis<\/a>.<\/p>\n<div class=\"post-quote\"><p>\u201cIt\u2019s a very tough housing market in Vermont, and people who were able and willing to pay rent, and could give good references, just weren\u2019t even getting a foot in the door and were being rejected.\u201d<\/p>\n<\/div>\n<p>\u201cWhat that means for people in the farmworking community is that we\u2019re obligated to stay on jobs where our rights aren\u2019t being respected and we\u2019re being abused, just because the farm is the only place where we\u2019re able to get housing,\u201d said the Migrant Justice member.<\/p>\n<p>Migrant Justice, which has <a href=\"https:\/\/civileats.com\/2015\/05\/11\/will-ben-and-jerrys-help-improve-conditions-for-dairy-workers\/\">long advocated<\/a> for the immigrant community, first approached the state legislature with their housing proposal in 2023; however, it didn\u2019t gain traction. <a href=\"https:\/\/www.vermontpublic.org\/local-news\/2025-04-10\/trumps-immigration-enforcement-casts-shadow-over-vt-housing-discrimination-bill\">According<\/a> to Vermont Public, landlords and bankers have been concerned that they couldn\u2019t run credit and background checks without a Social Security number.<\/p>\n<p>\u201cTo make a landlord have to take somebody\u2014even if they\u2019re not here legally\u2014I think is a challenge and a big ask,\u201d Angela Zaikowski, director of the Vermont Landlord Association, told lawmakers at a hearing in April.<\/p>\n\n<p>In the same article, Christopher D\u2019Elia, president of the Vermont Bankers Association, was quoted as saying, \u201cthe credit risk analysis becomes much more difficult and heightened,\u201d when lending to undocumented immigrants. If \u201ctwo weeks from now [they] may be deported, what\u2019s the credit risk of being able to get repaid on that loan?\u201d he added. \u201cThat is the reality we find ourselves in.\u201d<\/p>\n<p>Dodge spoke with landlord advocates who work nationally and learned that it\u2019s possible to run credit and background checks with just a name, address, and birth date.<\/p>\n<p>With this information, Dodge reintroduced the measure in the Vermont House of Representatives earlier this year as <a href=\"https:\/\/legislature.vermont.gov\/Documents\/2026\/Docs\/BILLS\/H-0169\/H-0169%2520As%2520Introduced.pdf\">House Bill 169<\/a>, using testimony from landlords, Migrant Justice members, attorneys, and bankers to negotiate the language.<\/p>\n<div class=\"post-quote\"><p>The Vermont Housing Conservation Board found that 85 percent of farmworker housing in the state needed improvement, and that a lack of additional dwellings on farms had led to overcrowding.<\/p>\n<\/div>\n<p>Determined to see it pass, Migrant Justice built a coalition of more than a dozen state government agencies and community organizations in support of the bill, including Housing and Homelessness Alliance of Vermont, Vermont Human Rights Commission, and ACLU of Vermont.<\/p>\n<p>\u201cMigrant Justice was really the spirit. They spearheaded the effort,\u201d Dodge said. \u201cAs the sponsor of the H.169 bill, my job was to lay the groundwork on the political and legislative side.\u201d<\/p>\n<p>The resulting measure was folded into S.127\u2014an <a href=\"https:\/\/www.campaignforvermont.org\/s127_2025#:~:text=May%252016%252C%25202025-,The%2520Senate's%25202025%2520housing%2520bill%2520(S.,disabilities%252C%2520and%2520other%2520marginalized%2520groups.\">omnibus housing bill<\/a>\u2014which received bipartisan approval.<\/p>\n<p>Now, with S.127 enacted, advocates say they hope the paperwork barriers that prevent immigrant farmworkers from accessing fair housing will be alleviated, giving them more autonomy to find better job opportunities and living conditions.<\/p>\n<p>\u201cWe\u2019re really happy to have this new law in place, because it means that workers aren\u2019t tied any more to jobs where we\u2019re being abused,\u201d the Migrant Justice member said. \u201cWe\u2019ll have the ability to find our own housing.\u201d<\/p>\n<p>Vermont is one of a handful of states to enact housing access protections for immigrants into law. <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201520160SB600\">California was the first<\/a>, passing its amendment in 2015. Other states, including Washington, New York, Oregon, Colorado, Washington, D.C., and Illinois, have also implemented similar measures.<\/p>\n<p>\u201cI think that it\u2019s so important that we pass legislation with the recognition that immigrant workers are people, and we have to address their whole experience and not just take advantage of them and exploit their labor,\u201d Dodge said.<\/p>\n<div class='ctx-module-container ctx_default_placement ctx-clearfix'><\/div><span class=\"ctx-article-root\"><!-- --><\/span>","protected":false},"excerpt":{"rendered":"<p>Moreover, landlords cannot refuse an application if that number is not provided; they must accept any form of unexpired government-issued identification.
